Acceptance of Terms
These Terms apply to your use of the Forum. By using the Forum, you agree to be bound by the Terms. If for any reason you do not agree to the Terms, you may not use the Forum.

1. Definitions
   1. A "User" is anyone who accesses, browses, or in any way uses the Forum. The terms "you" and "your" refer to you, as a user of the Forum. The terms "we", "us" and "Gore" refer to W. L. Gore & Associates Hong Kong Ltd.
   2. "Content" means the content Users submit, post or use in the Forum.

       

2. Eligibility
   You must be at least 18 years old and a registered member ("Member") of the Forum.

    

3. Changes to the Terms
   The Terms may be modified by us at any time. When changes are made, we will notify you by making the revised version available on the webpage and will indicate at the top of the webpage the date that revisions were last made. Any such modification will be effective upon our posting of the new Terms. You are bound by such modification and should therefore periodically visit these Terms by clicking on the link at the bottom of the Forum to review the then-current Terms to which you are bound. Your continued use of the Forum after any posted modification to the Terms indicates your acceptance of the modification.

    

4. User Accounts
   Only Members are allowed to use the service of this Forum. To become a Member you are required to register and provide your personal information. The collection and use of your personally identifiable information will be subject to our Privacy Policy.

    

5. Use of the Forum
   1. Subject to the restrictions of the Terms, We grant you permission to use the Forum, including the ability to:
   1. create topics and post messages and comments on the Forum;
   2. send messages to other Users;
   3. upload photos; and
   4. invite people you know to register with us.
   2. You may be exposed to Content which you may find offensive, indecent, inaccurate or otherwise inappropriate. Users take responsibility for postings under their identification and use the information provided in the Forum at their own risks.

    

6. Restrictions on Use
   You agree that you will not:
   1. post any Content that is obscene, defamatory, violent, sexually explicit, indecent or offensive. Users should not use obscene or indecent language as part of or whole of the registered names;
   2. use the Forum for promotion, advertising or commercial sales purposes;
   3. use the Forum to transmit or post spam, chain letters, surveys, or other mass messaging, whether commercial in nature or not;
   4. violate any third-party right, including any breach of copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right ;
   5. post pornography or illegal event s ;
   6. violate the Terms or any applicable law of the Hong Kong Special Administrative Region;
   7. post any Content that stray s away from the subjects of the Forum. Users are advised to keep their posts on topic;
   8. post insulting or vulgar Content which will offend or insult a specific national origin or political orientation;
   9. register for more than one account in the Forum;
   10. print or duplicate the postings of another User without the relevant consent;
   11. publicly attack any person or organization. Content attacking any brands or shops are prohibited;
   12. upload disproportionately large images to the Forum. Users are advised to follow the uploading limitations set by the Forum;
   13. Post your phone numbers, email address and other contacts.
   14. use any robot, spider or other means of monitoring, copying or searching the Forum.

    

7. Permission to Use Your Content
   You grant the following rights with respect to Content which you post:
   1. You grant us the worldwide, irrevocable, perpetual, royalty free right to use your Content (without compensation) for any purpose, including but not limited to the right to reformat it, edit it, publish it, incorporate it into other works, create derivative works and distribute it;
   2. You grant the Forum’s Users the irrevocable right to access your Content;
   3. You irrevocabl y waive any claims and assertions of moral right or attribution with respect to your Content.
   4. It is our policy to decline unsolicited suggestions and ideas. Notwithstanding our policy with regard to unsolicited suggestions and ideas, any inquiries, feedback, suggestions, ideas or other information you provide us (collectively, "Submissions") will be treated as non-proprietary and non-confidential s ubject only to the terms of our Privacy Policy . You acknowledge that your Submission may not be returned and we may use your Submission, and any ideas, concepts or knowhow contained therein, for any purpose including, without limitation, developing, manufacturing, distributing, and marketing products. You agree to indemnify us for all claims arising from or in connection with any claims to any rights in any Submission.

    

8. Responsibility for your Content
   1. You are solely responsible for your Content. You assume all risks associated with the use of your Content. We will not be liable for any loss suffered by you as a result of your posting to the Forum.
   2. You may expose yourself to liability if, for example, your Content violates a third party’s right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; contains material that is false, intentionally misleading, or defamatory or contains material that is unlawful.
   3. You agree to indemnify, defend and hold harmless Gore, its affiliates, officers, directors, employees, owners, consultants, agents, successors and assigns from any and all third-party claims, liability, damages and/or costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages and attorneys' fees) arising from (i) your violation of the Terms, (ii) your use of the Forum, or (iii) the infringement or violation by you of any third party’s rights.

    

9. Site Availability
   We reserve the rights to modify, update, or discontinue the Forum at our sole discretion, at any time, for any or no reason, and without notice or liability.

    

10. Investigations
    We are under no obligation to monitor the Forum or Content. However, we reserve the rights to investigate possible violations of the Terms, block Users from the Forum, and refer matters to law enforcement authorities for further investigation. We may disclose information to third parties, including your Content, in accordance with our Privacy Policy.

     

11. Termination
    1. We may terminate or suspend your account or ability to use the Forum, in whole or in part, at our sole discretion, for any or no reason, and without notice or liability;
    2. You may discontinue use of the Forum if you do not agree to these Terms as may be amended from time to time,

     

12. Rights of Gore
    1. We reserve the right to delete any Content that is in violation of the Terms;
    2. We reserve the right to revoke Users’ accounts if Content posted in such account is in violation of the Terms.

     

13. Governing Law
    These Terms shall be governed by Hong Kong law .

     

14. Disclaimer of Warranties

    The Forum is available "As Is." We do not warrant that the Forum will be uninterrupted or error-free. There may be delays, omissions, interruptions and inaccuracies in the Forum and the Content. We are not responsible for the availability, content or services of other websites that may be linked to or posted within the Forum. We do not make any warranties or representations, express or implied, including without limitation, those of merchantability and fitness for a particular purpose, with respect to the Forum or the Content. We do not make any representations as to the accuracy, satisfactory quality, completeness, non-infringement, compatibility, security, timeliness or reliability of the Forum or the Content. We do not accept any responsibility for any statement posted in the Forum. We reserve the right to correct any errors or omissions in the Forum. We will not be liable for any loss or damage caused as a result of using the Forum or viewing, reading or listening to Content. Although we intend to take reasonable steps to prevent the introduction of viruses, worms, "Trojan Horses" or other destructive materials to the Forum, we do not guarantee or warrant that the Forum does not contain such destructive features. We are not liable for any damage or harm attributable to such features. If you rely on the Forum or any Content, you do so solely at your own risk.

     

15. Notification of Copyright Infringement
    1. We will respond to clear notices of copyright infringement consistent with the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c)(2) ("DMCA") and its response to such notices may include removing or disabling access to the allegedly infringing content, terminating the accounts of repeat infringers, and/or making good-faith attempts to contact the user who posted the content at issue so that he may, where appropriate, make a counter-notification.  
    2. If you believe that your work has been used or copied in a way that constitutes copyright infringement and such infringement is hosted on the Forum, on sites linked to the Forum, or in connection with the services or materials, please provide, pursuant to the DMCA, written notification via regular mail or via e-mail of claimed copyright infringement to us (contact information below), which must contain all of the following elements:

        

       1. A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest that is alleged to have been infringed;
       2. A description of the copyrighted work(s) that you claim have been infringed and identification of what content in such work(s) is claimed to be infringing and which you request to be removed or access to which is to be disabled;
       3. A description of where the content that you claim is infringing is located on the Forum ;
       4. Information sufficient to permit us to contact you, such as your physical address, telephone number and e-mail address;
       5. A statement by you that you have a good faith belief that the use of the content identified in your notice in the manner complained of is not authorized by the copyright owner, its agent or the law; and
       6. A statement by you that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner’s behalf.

        

    Before you file such a notification, please carefully consider whether or not the use of copyrighted material at issue is protected by the "fair use" doctrine, as you could be liable for costs and attorneys’ fees should you file a takedown notice where there is no infringing use.

16. Miscellaneous
    The Terms constitute the entire understanding between you and us with respect to your use of the Forum. You may not assign these Terms. If any arbitrator or court of competent jurisdiction declares any provision of these Terms unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
